访问或使用 Neurako 的服务（包括我们的 iOS 应用、Android 应用以及位于 app.neurako.com 的网页端应用），即表示您同意受本服务条款的约束。

如果您不同意本条款的任何部分，请勿访问或使用本服务。条款可能会不时更新，建议您定期查阅。

本条款构成你与 Timothy Holbrook, operating under the brand Neurako 之间具有法律约束力的协议。如果你代表某个机构或组织使用本服务，即表示你已获得相应授权，可使该机构受本条款的约束。

Neurako 是一款由 AI 驱动的抽认卡与间隔重复学习平台。你可以通过拍照、录音或输入文字来记录内容，我们的服务会借助包含 Free Spaced Repetition Scheduler (FSRS) 在内的机器学习算法，将它们转化为个性化的学习卡组。

我们保留在发出合理通知的前提下，随时修改、暂停或终止部分服务的权利。

To deliver, secure, and improve the service, we may rely on third-party infrastructure, network, and security providers, including Cloudflare. Optional analytics may be provided by PostHog after consent. You must be at least 16 years old to create a Neurako account (GDPR Art. 8 default in Germany and most EU/EEA states). We do not offer the service to children below that age in the EU.

For users in the United States, we do not knowingly collect personal information from children under 13 (COPPA). If we learn that a child under 13 has created an account, we will delete it. Contact [email protected] if you believe this has happened.

付费订阅和代币包是这款学习应用的一部分。根据德国法律，未满 18 岁的人士在没有父母或监护人陪同的情况下订立付费合同可能会受到限制。Neurako 不会另行设置 18 岁以上的购买验证。

你同意不会将 Neurako 用于以下行为：

• 违反任何适用的法律或法规
• 上传侵犯他人知识产权的内容
• 尝试逆向工程、反编译或提取源代码
• 未经许可使用自动化工具抓取、爬取或提取数据
• 传播恶意代码、病毒或任何旨在破坏我们系统的软件
• 冒充任何个人或实体，或虚假陈述与某方的关联关系

违反本规范可能会导致你的账号被立即暂停或终止。

Neurako 会利用人工智能根据你记录的内容生成抽认卡。你知晓并同意：

• AI 生成的内容可能包含错误、不准确或遗漏。在将其用于学习备考前，你需要自行核对并确保 AI 生成抽认卡的准确性。
• AI processing is performed by third-party providers, which may include Google Gemini directly and OpenRouter as a routing provider for supported models (which may include models from Google, Anthropic, OpenAI, Black Forest Labs, and others depending on configuration).
• 根据你所使用的功能，你的录音、图片、文本提示词、导师对话文本、生成的学习内容以及用于导师记忆提取的精简输入，可能会被传输至 AI 服务商，且仅用于提供所请求的功能。

Neurako AI features are a learning aid only. They are not professional, medical, legal, or academic advice, and they are not a lawyer, doctor, or examiner. Outputs can be wrong. In-product labels identify AI-generated or AI-assisted content.

• Subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time; cancellation takes effect at the end of your current billing period. Upgrades take effect immediately; prorated charges apply for mid-cycle upgrades. Prices may change with 30 days’ notice to existing subscribers.
• 应用内购买将由 Apple App Store 或 Google Play 进行扣费，具体取决于你使用的平台。 For in-app purchases, Apple App Store or Google Play is the merchant of record. Use the store’s refund and withdrawal tools. Neurako cannot process those store refunds itself.
• Neurako does not currently sell subscriptions or token packs on the web. Paid purchases are made in the Apple App Store or Google Play, where the store is the merchant of record. 对于直接从我们网站购买的订单，可根据法定撤回权规则申请退款。
• Consumers in the EU/EEA have a 14-day right of withdrawal for distance contracts. Details, including digital-service Wertersatz and how to exercise the right, are on our Withdrawal page. German-speaking users know this as Widerruf. 请参阅我们的Withdrawal。

Neurako 平台（包括其软件、设计、算法、品牌和文档）均归 Timothy Holbrook, operating under the brand Neurako 所有，并受到著作权、商标权及其他知识产权法律的保护。

我们授予你一项有限的、非排他性的、不可转让的许可，仅供你出于个人非商业性教育目的使用本服务。

你在 Neurako 上创建或上传的所有内容（以下简称“用户内容”）均归你所有。通过使用我们的服务，你授予我们一项有限许可，允许我们仅出于向你提供服务的目的来存储、处理和展示你的用户内容。

我们不会对你的抽认卡卡组、笔记或你创建的任何其他内容主张所有权。你可以随时导出或删除你的内容。

本服务按“现状”提供，不包含任何形式的保证。我们不保证：

• 服务不会中断、毫无错误或完全安全
• AI 生成的内容绝对准确、完整或符合你的需求
• 服务能满足你特定的学习或专业要求

在法律允许的最大范围内，Neurako 不对因你使用本服务而引起的任何间接、附带、特殊或后果性损害承担责任。对于任何索赔，我们对你承担的全部责任总额不超过你在索赔前 12 个月内向我们支付的金额。

本条款中的任何内容均不限制我们因疏忽造成的死亡或人身伤害、欺诈或虚假陈述，或法律上不能排除或限制的其他任何责任。

你可以随时在账号设置中注销账号。如果你违反了本条款，我们可能会暂停或终止你的账号。

账号终止后，你使用本服务的权利将立即终止。在永久删除前，我们会将你的数据保留 30 天，在此期间你可以将其导出。

在适用法律允许的范围内，本条款受德意志联邦共和国法律管辖，排除法律冲突规则的适用。如果你是消费者，你居住国/地区的强制性消费者权益保护法规不受影响。

We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) under the VSBG.
